Terms of Service

Apex Claims AI

Effective Date: 01/15/2026


1. Acceptance of Terms

By accessing or using the Apex Claims AI website, platform, or services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

These Terms apply to all users, including visitors, customers, and subscribers.


2. Description of Services

Apex Claims AI provides a subscription-based software platform designed to assist medical offices with analyzing insurance claim denial documents using automated tools and artificial intelligence.

Important Clarification:
Apex Claims AI provides software tools only. We do not provide:

  • Medical advice 
  • Legal advice 
  • Billing or coding services 
  • Insurance guarantees or outcomes 

All insights provided by the platform are informational and intended to support users’ internal workflows.


3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services.

By using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


4. Account Registration

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information 
  • Keep your account credentials secure 
  • Notify us immediately of any unauthorized use 

You are responsible for all activity that occurs under your account.


5. Subscriptions & Payments


Subscription Model: Apex Claims AI is offered on a subscription basis, billed monthly or annually, depending on the plan selected.

Payments: Payments are processed securely through our third-party payment provider. By subscribing, you authorize us to charge your selected payment method on a recurring basis.

Taxes: Prices may exclude applicable taxes unless otherwise stated. You are responsible for any taxes associated with your subscription.

Late / Failed Payments & Service Suspension: If your payment method fails, we may suspend or terminate access until payment is received. You remain responsible for all amounts due up to termination.


All subscriptions automatically renew at the end of each billing period (monthly) at the then-current subscription fee unless cancelled prior to renewal. You are responsible for any recurring charges unless you cancel before the next billing cycle.


Payments are processed by Stripe under their terms and conditions and privacy policies. By subscribing, you also agree to Stripe’s processing terms.


6. Cancellation & Refunds


Cancellation

You may cancel your subscription at any time through your account or by contacting support.

Your subscription will remain active until the end of the current billing period.


Refunds

Refunds, if any, are provided at our discretion and evaluated on a case-by-case basis. We do not guarantee refunds for partially used subscription periods. Refunds are not guaranteed. We do not offer prorated refunds for partially used subscription periods unless required by law. To request a refund, customers must contact support within 7 days of the charge with justification. Any refunds issued are at our sole discretion and will be processed through Stripe.


If you believe a charge is incorrect, please contact support before requesting a chargeback. Chargebacks may result in additional fees and termination of service.

7. User Responsibilities

You agree not to:

  • Use the Services for unlawful purposes 
  • Upload content you do not have the right to use 
  • Attempt to reverse engineer or disrupt the platform 
  • Use the Services to provide unauthorized services to third parties 

You are solely responsible for how you use the information generated by the platform.


8. Uploaded Content & Data

You retain ownership of all documents and data you upload to the platform.

By uploading content, you grant Apex Claims AI a limited right to process that content solely to provide the Services.


Data Handling Notice

Apex Claims AI does not independently collect patient medical records. Any documents uploaded are provided at the direction of the customer and used only for analysis within the platform.


9. Data Security

We take reasonable measures to protect user data; however, no system can be guaranteed 100% secure.

You acknowledge and accept the inherent risks of transmitting information online.


10. No Warranties

The Services are provided “as is” and “as available”, without warranties of any kind.

We do not warrant that:

  • The Services will be error-free or uninterrupted 
  • Any analysis or output will result in specific insurance outcomes 
  • The platform will meet all of your business requirements
     

11. Limitation of Liability

To the maximum extent permitted by law, Apex Claims AI shall not be liable for:

  • Indirect, incidental, or consequential damages 
  • Loss of revenue, profits, or data 
  • Decisions made based on platform output 

Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.


12. Indemnification

You agree to indemnify and hold harmless Apex Claims AI and its owners from any claims arising out of:

  • Your use of the Services 
  • Your violation of these Terms 
  • Your uploaded content
     

13. Third-Party Services

The Services may integrate with third-party tools (e.g., payment processors, OCR providers). We are not responsible for the content or performance of third-party services.


14. Termination

We may suspend or terminate your account if:

  • You violate these Terms 
  • Your use poses legal or security risks 
  • Required by law or regulation 

Termination does not relieve you of payment obligations incurred prior to termination.


15. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.


16. Governing Law

These Terms are governed by the laws of the state in which Apex Claims AI is registered, without regard to conflict of law principles.

Apex Claims AI does not assume responsibility for regulatory compliance outside of its software functionality. 

No Guarantee of Results
Use of Apex Claims AI does not guarantee claim approval, reimbursement amounts, or processing timelines. Results may vary based on payer policies, documentation quality, and external factors beyond the platform’s control.
